I need to break my lease and i have no money to purchase my lease out but i filed bankruptcy last year. Can the property management company succeed in suing me?

The judgement was found through a credit search. The lawyer has prefabricated no attempt to contact stated mortal over the past 7 yrs. The interest continues to rise and they won’t settle or release so that stated mortal can buy a home. Do they have the right to just let the amount continue to get higher?

Depending on the say where you live, judgments can last up to 10 years (my say is one such state).
You can’t stop lawyer from pursing money owed to his client. Only courses of action would be for you to 1- offer to pay on creditor’s terms, 2-continue to not pay and move out the next 3 years, 3- look for a mortgage lender whose underwriter will overlook that debt.

When you get a summons to go to court and you don’t show up at the appointed date/time, you will get a default judgment against you based solely upon the fact that you didn’t show up…So the other side wins by default and you will end up having to pay money…even if you didn’t owe it in the first place.
NEVER ignore a summons to go to court.

Superficially the current median income (per household size) for NY is:
1 mortal ,803
2 people ,898
3 people ,477
4 people ,966
In other words, if you acquire less than that amount (depending on your household size) in NY you are automatically eligible to file Ch 7 (the bankruptcy Chapter that discharges all debts).
If you acquire more than the median, it does NOT mean that you automatically must file Ch 13 (the one in which you commit future disposable income to at least partial repayment of your debts). It means that your attorney will need to complete the “long form” of the Means Test, which grants deductions for various expenses (similar to the long form of an income tax return). Most bankruptcy attorneys report that a great many clients who, on first glance, APPEAR not to pass the Means Test, actually do pass it (i.e., can file Ch 7) after all the acquirable deductions are taken on the Long Form of the Means Test.
Make an appointment with a local bankruptcy attorney to receive an assessment of your particular situation. Most offer one free or very low cost appointment to review your particular financial situation and advise you regarding your bankruptcy and non-bankruptcy options.

I won a law suit and the 30 days have passed for the individual to pay me. My next step is to go through the Marshall Service to collect the debt, most likely through remuneration garnishment. My question is, how do I find out the persons employer? I am inactivity to hear back from the Marshalls, but can they find out? Or is it my own responsibility?

What state? You need to do an quality search or find an bureau that will do that for you. There are tons of paid online searches but be careful of which you choose.
You might find yourself renewing this judgment for many years if the mortal is a deadbeat.

I had a default judgement on me for a debt. it was beacuse of the clerks error(placed my answer in a different file) anyways the judge vacates it. and set a scheduling order, do i get a scheduling order or does a plaintiff, and who sets the dates? or is a scheduling order for the plaintiff to comply with my discovery?

Both celebrations will get a copy of the scheduling order. It sets the dates that discovery is to be completed by, and the deadline for filing any dispositive motions (such as summary judgment).

I would do A LOT of research before I gave them any financial information. The can and probably did pull your credit report so they have some info already.

Now the latest company who has purchased the debt has filed papers in my local county court to place a judgement on me for the unpaid money. Can they do this? I thought that only the original company could do this?

Did you ever get a 1099-C for the cancelled debt? When the debt is legally charged off, they have to issue you one if the debt is more than 0. (Then it’s taxable income on your tax return.)
If you didn’t get the 1099-C, they might have never really cancelled it and yes, if they sell it, it’s a legal debt still. The mortal who purchases it can take you to court.
