I had a judgement allowed against me for $ 8,000 6 years ago, I work and I don’t have garnished consequence and I have automobiles in my name, I have a few grand in a savings account, do these companies have the power to go after assets and it doesn’t look like they have if so how long do they have and what is typical with old judgements like how long to oppose this if at all.

It can sit on your credit for 10 years in public records. It just gains interest till paid off. If you own your own home they attached it as a lien that will get paid if you ever refinance or sell the home. In some says it is attached for up to 20 years.They might also go back and get the judgment extended by the courts and begin garnishment at any point in time

Hello, I have recently filed a “motion to leave judgment” to stop a garnishment of consequence from a credit card company. The motion was accepted and I have a hearing in about two months. I’m convinced I will be healthy to get the judgment vacated but my question is does filing this motion temporarily stop the remuneration garnishment until the hearing date or will my consequence continue to be garnished until the hearing date?

Your consequence will continue to be garnished. Had you filed your motion promptly…usually within 20 to 30 days of the judgment date, your consequence would not have been garnished in the first place. RJ

U cant stop it!! Look on the back of the judgement letter that says how much was going to be taken, the backside will give u a couple of ways to fight it. BUt believe me it wont be worth it, cause they will make u pay anyways!!

* Thanks for all the feedback. When I state “discharged” that means that the consumer has already filed bankruptcy and has been cleared of there obligation. What does the “creditor” do with the debt? I’ve gotten good answers and would like to hear more. thanks!

If you have a judgement filed against you I recommend you make payment arrangements with them pronto. If you ignore them (or the do not concur to work with you as far as payments) they have the capability to seize bank accounts, individualized property, or garnishee your consequence to get what you owe them.

Today is the deadline date for the individuals and company my attorney filed my claim aganist to anwser, .They have not responded to my claim filed aganist them, so far and I am wondering when will it be ok for my attorney to file for a default judgement. Thanks Robin G. IN LA

i think most people regardless of position have a pretty good chance of getting a low limit credit card – you might be started at 0 – 0 and healthy to increase after making timely payments. I would recommend chase.com,they seem to be pretty fair. or go to the bank and apply where you have your checking statement – because they know you and your history with them.

Winning a judgment is just half of your battle. If they don’t pay, you could place liens on any bank accounts or any other assets that the company owns.

after. The judge might still throw it out, but at least it has standing then.
