What kind of lawyer do I need to Q’s caused by credit card & bank statement Judgement automobile will be confiscated.
I don’t want to file bankruptcy, because fraud was involved in my debt. (No harsh comments, please… I messed up bad, I know).
I’m inheriting a used, paid-off automobile worth $ 3000. I live in Michigan. I’m also worried about the funds in my bank account. I’m cashing a massive check and the bank requires me to deposit it for 5 days before withdrawing.

can you open another bank statement at a new bank? I messed up bad myself years ago and had to pay off the debt to the men in black trench coats! It takes time to make it right. Do the right thing and it will work out for you.

I had a judgement allowed against me for $ 8,000 6 years ago, I work and I don’t have garnished consequence and I have automobiles in my name, I have a few grand in a savings account, do these companies have the power to go after assets and it doesn’t look like they have if so how long do they have and what is typical with old judgements like how long to oppose this if at all.

It can sit on your credit for 10 years in public records. It just gains interest till paid off. If you own your own home they attached it as a lien that will get paid if you ever refinance or sell the home. In some says it is attached for up to 20 years.They might also go back and get the judgment extended by the courts and begin garnishment at any point in time

Hello, I have recently filed a “motion to leave judgment” to stop a garnishment of consequence from a credit card company. The motion was accepted and I have a hearing in about two months. I’m convinced I will be healthy to get the judgment vacated but my question is does filing this motion temporarily stop the remuneration garnishment until the hearing date or will my consequence continue to be garnished until the hearing date?

Your consequence will continue to be garnished. Had you filed your motion promptly…usually within 20 to 30 days of the judgment date, your consequence would not have been garnished in the first place. RJ

* Thanks for all the feedback. When I state “discharged” that means that the consumer has already filed bankruptcy and has been cleared of there obligation. What does the “creditor” do with the debt? I’ve gotten good answers and would like to hear more. thanks!

I always had excellant credit and an excellant business I was involved in a bad happening that caused permanent injuries. As a result all my bills became deliquent and my wife didnt acquire enough to take over all the responsibilties. Now I am getting judgements against me. We had no shared credit accounts and I have nothing in my name. I want to pay my bills but it is out of the question right now.Can they touch the home that isnt in my name?

It depends on what say you live in but usually yes if there is equity in the home. If your debts are in the 10s of thousands and your home has at least that much equity, I would take out a loan against your house. If your home does not have enough equity to cover your debt, I would think about bankruptcy. It is evenhandedly simple to file and a good lawyer can help you keep your home in the process.

If you have a judgement filed against you I recommend you make payment arrangements with them pronto. If you ignore them (or the do not concur to work with you as far as payments) they have the capability to seize bank accounts, individualized property, or garnishee your consequence to get what you owe them.

I owe a card card 8k and they sold or engaged a law frim to take me to court, have recieved papers. I have no asset’s other than a car for which I still owe 18k. I am owe the IRS 77k and pay 0 a month in alimony. I receive a small pension check each month. Have no money for a lawyer. My credit is already in the crapper. Other than selling a kidney, what other restitution can I expect?

I have about 6 credit cards way past due. Most of them are in collection agencies. The highest equilibrise I have on any card is around ,300. All together less than ,500. This law firm called me and informed me that they will get a jugdement against me and garnish my consequence if I do not settle the debt(this statement has equilibrise of around 0) I DO WANT TO PAY BACK. But I have a small job and planning to go back to school!!!Will a judgement deny me a US passport? Do you think they will go to court for such a low debt??? People with much higher debt get away from it. I do accept my mistake though

From what I understand, only owing money in past due child support then will deny your passport.
